The Student Tribunal dismissed the petition filed against the Student Central Board (SCB) over their failure to convene the annual Lideratos General Assembly, ruling that no breach of law occurred due to the Student Congress's (SCon) procedural gap.

In its Resolution No. 2025-02 dated 10 May, the Tribunal stated that the Annual General Assembly Act of 2024 requires an enabling resolution from the SCon to officially set the date of the assembly. Since no such resolution was passed, Lideratos executives, led by President Ianthe Rosanes, could not be held liable for not carrying out a never-scheduled act.

“In the present case, the absence of such a resolution hinders the Student Central Board from planning and convening the Assembly,” the Tribunal wrote.

The petition, filed by first-year BS Accountancy student Rodzerach Patriarca, alleged negligence and inaction on the part of the SCB. However, the Tribunal found that while the assembly did not take place, its core objectives were nonetheless pursued through alternative means.

The Tribunal emphasized that these actions amounted to "substantial compliance in good faith" with the spirit of the Act, even if procedural requirements were unmet.

“To penalize the Respondents for prioritizing student welfare… would contradict the spirit of the Act, as well as discourage initiative and responsiveness in future scenarios of the same nature," it added.

The Annual General Assembly, as required by the Act, is meant to be held once every academic year, within the first month of the second semester. However, the specific date, time, and venue must first be determined by a resolution passed by the Student Congress and signed by the SCB President. No such resolution was passed this year, preventing the assembly from being officially scheduled.
